Agreement and Waiver of Liability
This agreement is made between the undersigned client ("Client") and the service provider ("Provider") for the purpose of providing a battery jump start service for the Client's vehicle. By signing this agreement, the Client acknowledges and agrees to the following terms and conditions:
1. Acknowledgment of Risk
The Client acknowledges that the process of jump-starting a vehicle's battery involves certain risks, including but not limited to, damage to the vehicle's electrical system, battery, alternator, starter, and other related components. The Client understands that while the Provider will take all reasonable precautions to avoid any damage, such risks are inherent in the nature of the service.
2. Waiver of Liability
The Client agrees to release, waive, discharge, and hold harmless the Provider, its employees, agents, and contractors from any and all liability, claims, demands, actions, or causes of action arising out of or related to any damage that may occur to the vehicle during the battery jump start process, including damages resulting from electrical surges, incorrect connections, or pre-existing conditions in the vehicle's battery or electrical system.
3. No Guarantee
The Provider does not guarantee that the vehicle's battery will be successfully jump-started without any issues. The Client understands that factors such as the condition of the battery, the age of the vehicle, and pre-existing electrical issues may affect the success of the jump start and may increase the likelihood of damage.
4. Client's Responsibility
The Client acknowledges that it is their responsibility to ensure that the vehicle is in a suitable condition for a jump start and that any pre-existing damages or issues are documented before the service begins. The Client agrees to inspect the vehicle immediately after the service and to report any new damages to the Provider.
5. Damage Reporting
In the event that the Client discovers any damage to the vehicle after the battery jump start service has been performed, the Client must report such damage to the Provider within 24 hours of the service completion. Failure to report damages within this time frame will result in the Client's forfeiture of any right to claim damages.
6. Special Considerations
The Client acknowledges that the jump-start process may not be successful if the battery is severely discharged, damaged, or if there are underlying electrical issues with the vehicle. In such cases, the Client understands that alternative solutions, such as battery replacement or towing, may be necessary.
7. Additional Services
The Client understands that any additional services provided during the battery jump start, such as towing or battery replacement, may carry additional risks and are also subject to this waiver of liability unless otherwise specified in a separate agreement.
8. Entire Agreement
This agreement constitutes the entire understanding between the Client and the Provider regarding the battery jump start service and supersedes any prior discussions, agreements, or representations. Any amendments or modifications to this agreement must be made in writing and signed by both parties.
